ORDINANCE NO. 895
AN ORDINANCE OF THE CITY OF LOUP CITY, NEBRASKA, ADDING SECTIONS 91.20 THROUGH 91.27 TO THE CODE OF ORDINANCES OF THE CITY OF LOUP CITY; PROVIDING A TIME WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT AND REPEALING ALL OTHER ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF LOUP CITY, NEBRASKA:
Section 1. That the Mayor and City Council of Loup City, Nebraska, do hereby add Sections 91.20 through 91.21 to the Code of Ordinances of the City of Loup City, as follows:
VACANT BUILDINGS
§91.20 PURPOSE AND FINDINGS.
(A) Vacant properties have the potential to create a host of problems for the community, including a propensity to foster criminal activity, create public health problems, and otherwise diminish quality of life;
(B) Vacant properties have the potential to reduce the value of area properties, increase the risk of property damage through arson and vandalism, and discourage neighborhood activity;
(C) Vacant properties represent unrealized economic growth in the City of Loup City;
(D) Vacant property registrations would allow the city to discourage property vacancy, maintain unoccupied buildings, provide a database of vacant properties and their owners, and assess fees for the increased public costs associated with vacant properties;
(E) Fees imposed under a vacant property registration ordinance have the potential to benefit the owners of vacant properties by helping to finance additional government services to protect he value and security of such properties; and
(F) Enactment of a vacant property registration ordinance is a proper exercise of governmental authority to protect the public health, safety and welfare of Loup City residents and is authorized pursuant to Neb. Rev. Stat. §19-5401 et seq.
§91.21 DEFINITIONS.
The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
(A) Building means a building, accessory structure, mobile or modular structure, or other structure used for commercial, residential or mixed purposes.
(B) Calendar year means a period of one year starting January 1 of the given year and ends on December 31st of the same given year.
(C) City means the City of Loup City, Nebraska.
(D) Commercial activity means having the objective of supplying commodities (goods and services), industrial uses, industrial manufacturing and ancillary business functions.
(E) Commercial building means a building with more than fifty (50) percent of its floor space use for commercial activity. For the purposes of this section, floor space shall be designated as the area on the main or street level of the building.
(F) Evidence of vacancy means any condition or circumstance that on its own or in combination with other conditions or circumstances would lead a reasonable person to believe that a commercial building or residential building is vacant. Such conditions or circumstances may include, but are not limited to:
1. Lack of active utility service accounts for at least 180 consecutive days;
2. Overgrown or dead vegetation, including grass, shrubbery, and other plantings;
3. An accumulation of abandoned personal property, trash, or other waste;
4. Visible deterioration, unsecured building, or lack of maintenance of any building on the property;
5. Graffiti or other defacement of any building on the property; or
6. Any other condition or circumstances reasonably indicating that the property is not occupied for commercial or residential purposes or being used for the operation of a lawful business.
(G) Owner means the person, persons or entity shown to be the owner or owners of record on the records of the Sherman County Register of Deeds.
(H) Residential building means a house, condominium, townhouse, apartment complex or trailer house.
(I) Vacant means that a commercial or residential building exhibits evidence of vacancy. Storage does not constitute occupancy unless authorized by the zoning ordinance of the city.
(J) Zoning Administrator means the person or persons authorized and empowered by the City to administer and enforce the requirements of the City of Loup City Zoning Ordinance.
§91.22 PROGRAM ADMINISTRATOR.
The city zoning administrator or his/her designee is designated as the program administrator. The program administrator may utilize additional city employees as may be necessary to administer the program with the approval of the Mayor.
§91.23 VACANT BUILDING REGISTRATION.
(A) The owner of a vacant commercial or residential building or shall register the building with the City Clerk or the Clerk’s designee if the property has been vacant for at least one hundred eighty (180) consecutive days. A vacant property registration form shall be in either paper or electronic form, and the following information shall be required:
1. The name, street address, mailing address, telephone number, and, if applicable, the facsimile number and email address of the property owner and his or her agent;
2. The street address and parcel identification number assigned by the Sherman County Assessor of the vacant property;
3. The transfer date of the instrument conveying the property to the owner;
4. The date on which the property became vacant; and
5. A plan for occupancy of the property.
(B) The owner shall notify the city of any changes in information supplied as part of the vacant building registration within 30 days of the change. Removal of the property from the vacant property registry shall occur when the property is no longer vacant as determined by the Zoning Administrator.
§91.24 VACANT BUILDING FEES.
(A) The vacant property registration fee shall be $250.00 for a residential property and $1,000.00 for a commercial property due and payable one hundred eighty days (180) days after initial registration of the vacant property pursuant to this section or three hundred sixty (360) days after the property becomes vacant, whichever is sooner.
(B) Supplemental registration fees at intervals every six months thereafter shall be due for as long as the property remains on the vacant property registry. The supplemental registration fee of ten times the initial registration fee amount.
(C) A subsequent owner or owners of property subject to this Article shall assume the obligations, including the time of vacancy, of previous owner or owners.
(D) Registration fees shall be refundable for the year preceding the date on which the property is no longer vacant.
§91.25 INSPECTIONS.
The program administrator or his or her designee shall inspect the interior and exterior of the vacant property upon submission of a plan of renovation and prior to approval by the program administrator, and upon registration, at one-year intervals thereafter for so long as the property remains on the vacant property registry, and upon the failure to complete the plan of renovation previously approved by the program administrator. If a building is determined to be unsafe by the Zoning Administrator, it shall be subject to the requirements of Sections 91.30 through 91.39 of the City of Loup City Code of Ordinances.
§91.26 PENALTIES.
(A) Vacant property registration ordinance (§§91.20 through 91.25) shall be enforced by municipal fines for failure to comply with its requirements of $100.00 per day of violation.
(B) The city may enforce the collection of vacant property registration fees by civil action in any court of competent jurisdiction. Unpaid property registration fees and unpaid fines for any violation of a vacant property registration ordinance shall become a lien on the applicable property upon the recording of a notice of such lien in the Sherman County Register of Deeds Office.
(C) The lien created under this subsection shall be subordinate to all liens on the applicable property recorded prior to the time the notice of such lien under this subsection is recorded.
(D) The provisions of the Vacant Property Registration Ordinance shall be supplemental and in addition to any other laws of the State of Nebraska relating to vacant property.
Section 2. That any ordinance or section passed and approved prior to the passage and approval of this ordinance and in conflict with its provisions, is hereby repealed.
Section 3. This ordinance shall take effect and be in full force after its passage, approval and publication or posting as required by law.

Notice is hereby given to all persons interested that the books of The Farwell Irrigation District are now on file in the office of the Secretary of The Farwell Irrigation District in the Town of Farwell, Howard County, Nebraska, and the same will remain open in said office for the inspection of all persons interested.

The Sherman County Board of Commissioners will be accepting bids for mowing at Bowman Lake Recreation Area for the 2025 season. Mowing would consist of both sides of the road enter-ing and going through the park area and all camping and picnic sites (as shown on the map).
